In order to be eligible for an “Official business account”, business names can’t include:

  • All capital letters, except for acronyms. Only the first letter of each word can be capitalized, conjunctions may not be capitalized. For example:

    After choosing a business name for your new company, you will want to register it to prevent others from using it. There are several ways to accomplish this.

    Determining the best way to register a business name will take into consideration several factors, such as the business structure, the geographical area in which the company will operate, and the extent of protection needed.

    How to Register a Business Name

    The three ways a business may register a name are:

    1. Form a business entity, such as a corporation or limited liability company (LLC).
    2. Register the business name as an assumed name or DBA (“doing business as”).
    3. Register the business name as a federal trademark.

    Not all businesses can use all three of these methods, and some may use more than one.

    The choices may vary depending upon whether the business is structured as a sole proprietorship, some form of partnership, an LLC, or a corporation.

    To illustrate the possibilities, we will explore the various options of a fictional business. In our example, Robert Hansen opens a residential home rental business after buying one house for this purpose. He begins by operating as a sole proprietorship and uses the name “Robert Hansen, Property Rentals” for the business. In time, Robert acquires more properties and decides he wants a new name for his business.

    Forming a Business Entity

    One option for Robert is to create a corporation or an LLC. To do so, he must file certain registration documents with the appropriate state agency. This requires the business to choose its legal name.

    State laws prohibit a company from using a name that is already being used by another company. So, part of selecting a name involves checking the state’s records to be sure another company is not already using the desired name.

    Robert wants to use the name “Sunrise Properties” and determines that name is available. He might file articles of incorporation under the name “Sunrise Properties, Inc.” Or, he might file articles of organization under the name “Sunrise Properties, LLC.” This would prevent other companies from using the name “Sunrise Properties” in his state.

    Creating a corporation or LLC only provides protection in the state of registration. If Robert decides to expand into another state, he may be able to register his corporation in the new state, providing the name is not already registered there.

    Registering an Assumed Name

    Any sole proprietorship, partnership, corporation, or LLC that does business under a name other than its own, must register the other name as an assumed name.

    This is often done with a county agency, but may be with a state agency in some states. This is called a fictitious name in some locations and is also commonly referred to as a “doing business as” or “dba” name.

    If Robert wants to continue operating as a sole proprietorship, he may be able to register the name “Sunrise Properties” as an assumed name. Robert could then use the name “Sunrise Properties.”

    Anyone checking the official records would be able to see that his business is actually “Robert Hansen dba Sunrise Properties.”

    Assumed name registration is not limited to sole proprietorships. Let’s suppose Robert forms Sunrise Properties, Inc., and decides to start a yard maintenance business that uses a different name. In this case, Sunrise Properties, Inc., might register “Sunrise Lawn Services” as an assumed name. This would then be “Sunrise Properties, Inc., dba Sunrise Lawn Services.”

    Instead of forming a corporation or LLC, let’s suppose Robert takes on Laura Deever as his partner. Their partnership might register “Sunrise Properties” as their assumed name. Or, for another example, they might combine their surnames and register “Han-Dee Properties.”

    Assumed name registration usually only protects the name in the county where it is registered. If the business plans to operate in more than one county, registration would be required in each county.

    Trademark and Trade Name Registration

    Trademark, trade name, or service mark protection may be available on a statewide basis. The requirements for registration vary from state-to-state. Such registration must be done in each state where the business operates.

    A more complex, and usually more expensive, way of registering a business name is by registering the name as a trademark with the United States Patent and Trademark Office.

This website will also check if the names are available for online purchase. This is especially handy for online businesses or eCommerce websites. Dot-o-mator allows you to either select from random words using two drop-down lists or to type your own suggestions on the boxes provided (for both “beginnings” and “endings” of the business name being generated), and then when you click combine, you are given a list of results of available business and domain names. When you see a name you like, you can drag it over to a “scratchbox” and keep on searching.

    2. Wordlab Business Name Generator

    The Wordlab Business Name Generator produces more than seven million potential suggestions for company, business, brand, and product names or available domain names. Don’t see anything you like after using the generator? You can sign up instead for a Worldlab account and post a topic in their Naming Projects Forum, and members of the community can help suggest names for your brand, business, or project. Either method should help you generate a business name that’s worth moving forward with!

    3. NameMesh Domain Name Generator

    NameMesh.com is a down and dirty, lighting-fast domain name generator. Just type a keyword in the field provided, click on the search button, and the generator will list down suggestions of the available business and domain names closely related to your preferred keyword. You can also register your domain name through the links provided by NameMesh.

    4. Naming.net

    The official naming generator of letter-template business Write Express lets you input specific criteria to help you produce a list of more than eight hundred possible names for every single search. You can type in a specific keyword you already have in mind and choose to combine it with Greek and Latin prefixes, suffixes, or root words; beginning and ending word parts; and different types of rhymes: ending, beginning, or last and syllable.

    5. Lean Domain Search

    If you’re looking for a handy business-name generator that can produce brand and business suggestions in seconds, then Lean Domain Search is for you. This website matches the keyword that you entered with other words to generate a substantial list of available domain names. You can choose word suggestions that start or end with your keyword, and—depending on your preference—you can also sort results of your search by popularity, length, or alphabetical order.

    6. Net Substance Brand Name Generator

    Net Substance Brand Name Generator helps you generate a business name by randomly generating new options based on the keyword that you input. Type one or more keywords that closely relates to your brand or business, then click the “Generate Brand Names” button to produce a list of original brand names. You can determine whether or not the domain name of a particular generated business name is available by clicking on that particular name, which will query the Whois database and will tell you whether it is already registered. You can also increase or decrease the number of letters that make up your brand name by changing the values in the “Maximum Letters” field.

    Today’s post is about seven pitfalls to avoid when you create a brand and business name.

    Your business name is an important element that’s directly linked to your ability to grow.

    Your business name can make your brand or it can break it.

    Don’t hinder your progress by painting yourself into a corner with a name that will hold you back.

    1. Avoid initials or acronyms when you create a brand and business name

    The first thing to aim for when you create a brand is communication. Ideally, your business name says what you offer in an instant.

    Acronyms and initials may not make much sense to someone who comes across them.

    Avoid them. Instead, aim for a name that says what you offer in clear language.

    2. Steer clear of similar-sounding names

    Creating a brand and business name that’s similar to something that’s already known in your market may seem like a good idea. But why spend your marketing dollars trying to differentiate your business from your competitors’ businesses because your names are so similar?

    Don’t be afraid to come up with a name that’s unique and will stand out from what’s already out there.

    3. Stay away from your own name

    If you’re just starting a new business, selling it and handing it over to someone else might be the last thing you’d think about.

    But it happens every day. People build a profitable business they name after themselves and suddenly they’re fielding offers from interested buyers.

    Part of what the buyers look at when valuing a company is “brand equity.”

    If a business has laid the groundwork for a strong, recognizable brand over many years, that’s worth real money.

    If you’ve used your personal name as your business name and you plan to exit from the daily operations of your business, that brand equity will go with you.

    Your company won’t be as valuable if your name is on it — but you’re not around.

    There are exceptions, of course. If you’re a counselor, attorney, life coach or artist, for example, it might make sense to use your own name as your business name. You are your business, so stating your name and crafting a tagline that explains what you do may be all you need.

    But those businesses aren’t easy to sell or hand over to someone else: they’re very dependent on the work of one person. Keep this in mind and choose carefully.

    4. Don’t get too specific

    One of the most difficult aspects of naming your business is that it happens so early. When you’re just starting your business, you may not know exactly what you’ll focus on yet, or who your ideal customer will be.

    That’s why it’s best to avoid ultra-specific names that are tied to a particular product or service, like Rattan Rockers Inc. (what if they want to offer wicker furniture?), or Just Desserts Deliveries (what if they decide to expand into delivering sandwiches?).

    5. Don’t be generic (and forgettable)

    I know, I know. I just told you not to be too specific, and now I’m saying not to be too generic!

    It’s important that either your company name or your tagline explain what you offer. For more on this, read How to Write a Terrific Tagline.

    It’s best to avoid names like Fernstone, Inc., Marvin & Sons, and The Gilberton Company. These names say nothing and mean nothing. Using a name like this means you’ll have to spend valuable time establishing what you do before you can move on to building trust and comfort.

    6. Avoid made-up words as you create a brand and company name

    Xerox.
    Google.
    Kodak.

    They could afford to pour their money into establishing the meaning of the made-up words they used for brand names. Can you?

    If you’re running a small business and your marketing budget is tight, chances are you can’t.

    Don’t be too clever when you create a brand and company name. Stick to using words that already have a meaning rather than making up words and having to explain yourself.

    7. Steer clear of trends (they guarantee obsolescence)

    Allied Carbon Paper.
    Dave’s VCR Rental.

    United Ice Block Home Delivery.

    These businesses may have existed at one time, but not anymore. They built names around specific technologies, and those technologies disappeared.

    Be aware that this may happen to the business you’re building right now. Focus on the benefit your product or service will offer and don’t mention the technology you’ll use to offer it.

    Bonus pro tip: Check the availability of a URL before you create a brand and company name

    The website you create for your new business will be one of your most important marketing tools.

    Before you commit to a business name, be sure you can find a website address — a domain name — for your favorite name.

    Domain names ending in .com are the industry standard, so don’t plan to grab the .biz version of the name you want if the .com isn’t available. Doing that is a sure way to send lots of visitors to the website of the owner of the .com URL.

    Instead, keep searching until you find a name that meets the criteria in this post and is available for purchase.

    Your name is everything. As people become familiar with and get to know your business, your name represents you, your business, your reputation, your worth and your credibility. So choose well. But you can’t choose just anything. Someone else may have already taken your brilliant idea for a business name. There’s a way to check to make sure you choose and register a name unique in your state.

    Check your name ideas against your state’s database of existing business names. Someone else may have your proposed business name already. Most states, including Kansas, Indiana and Oregon, make such a database available on their secretary of state’s website. Other states, like California, accept name checks only by mailed letter of inquiry.

    Create a new name or incorporate in another state if your desired business name is already taken and you are really set on it. Incorporating in other states can be more complicated, and you should look into regulations regarding foreign corporations in both your state and the state you propose for incorporation. You may want to consult an attorney before moving ahead.

    Check your name against business names in other states. Just because a company is incorporated or registered elsewhere doesn’t mean it doesn’t compete in your market. If you prefer to avoid confusion or competition with a similarly named business, you may want to go back to the drawing board. Oregon’s business name registry is an example of a registry that also allows you to check databases of other states for precisely this purpose.

    Reserve your business name if your state accepts reservations and you need a little time to put together your incorporation or other business organization documents. Kansas, for example, does not take reservations, while California will reserve a name for 60 days for a $10 fee.

    Prepare and file your articles of incorporation or documents establishing a limited liability partnership or a limited liability company. Some states, like California, register names only for businesses with one of these two company structures. Other states allow proprietorships and partnerships to register their name also. Information is available on every secretary of state’s website. You may also wish to consult an attorney when preparing critical business documents.

    A business name has done its job if it causes a person to pause for a second. And it’s even more valuable if you can remember it long after that pause. Memorability matters.

    So how do you create a memorable name? In a 2003 article from the Journal of Advertising, the authors cited the following features that enhance either the recall or recognition of brand names:

    • Rhyme
    • Unusual spelling
    • Onomatopoeia
    • Initial hard consonant
    • Wordplay
    • Brand-name fit

    Let’s look at a few in greater detail, along with some other factors that influence memorability.

    Familiarity

    This isn’t in the above list, but it’s worth acknowledging. The same Journal of Advertising article says that familiarity plays a larger role in brand-name memorability than the linguistic features of the name.

    Repetition is one of the most effective ways to make a name familiar. That’s the idea behind advertising: repetition to create familiarity. So more familiar brand names are more memorable because we see them more often. For example, AT&T is one of the largest spenders on advertising, year after year. I certainly remember the name, although it isn’t inherently memorable. But it’s everywhere, from billboards to buses, on my telephone, and on TV. The brand achieves familiarity through ubiquity. So the more familiar a brand is, the less important linguistic devices are.

    Rhyme

    Poets know this, and now you do, too: Rhyme aids in memory. While rhyme is common in many formats, this technique is especially common with consumer-facing brands:

    • Reese’s Pieces
    • Lean Cuisine
    • Slim Jim

    Rhyming isn’t restricted solely to food companies. Following is a range of companies using the device. They don’t feel forced or gimmicky because the parts of the name are related to what they do.

    • FireWire
    • StubHub
    • Crunch ‘n Munch

    Crunch ‘n Munch gives you a hint at the texture and addictive nature of the treat. The rhyme of StubHub is almost a sentence. You get the idea that it’s a place where you can buy tickets. And FireWire’s rhyme is a metaphor: You get the sense that the wire transfers information fast. Rhyme can work for more grown-up businesses if the words give you valuable information about the business or product.

    Unusual Spellings

    Does Kraft stick with you more than the standard Craft? Krispy Kreme or Crispy Cream? Research says unusual spellings can make a name more memorable. Building on the previous point about rhyme, here are two names that do both:

    • Laffy Taffy
    • Mello Yello

    The unusual spelling combined with the rhyme reinforces the youthful nature of the product and likely its memorability. The trend of unusual spellings was common in the middle of the 20 th century and has become common again, especially online. A scarcity of URLs spurred this trend among startups. Some examples include:

    • Digg
    • Flickr
    • Reddit

    As more URLs became available, this trend has slowed. Is there space for you to use an unusual spelling purposefully? When Twitter launched, it was called “twttr” (without the vowels) because Twitter.com was owned by someone else. That trend subsided, and it got large enough to buy the domain, so it changed its name to Twitter. But remember: There’s a fine line between memorable and cute. And your brand may not want to be cute.

    Onomatopoeia

    This is a big word for a simple idea. Some words sound like what they represent: snap, crackle, pop, twitter. Some brands use this tool, like the zip in Zipcar. Does that make it sound easier and quicker to use than its competitor, Car2go? What about Meow Mix? Would your cat like it better than Purina Cat Chow? It might be more memorable, especially with variations of the tag line: “Tastes so good, cats ask for it by name.”

    Names that sound like what they represent tend to be more memorable. Ask yourself if this fits with what you’re trying to create.

    Initial Hard Consonant

    According to research in reading studies, words starting with hard consonants (t, k, p, d, g, v) are more memorable than words starting with vowels or softer consonants. They’re also considered stronger. In fact, recent studies indicate that the use of consonants and their placement can affect the perceived gender of a brand.

    The sound of the consonant matters. Consider a spinoff company from Kraft Foods, Mondelez. Mondelez manages such brands as Cadbury, Chips Ahoy, Honey Maid, Toblerone, and Triscuit. The name Mondelez is a new word made from Latin parts like mundus, meaning world. It’s intended to invoke the idea that there’s a whole delicious world out there. However, compared to Kraft, “Mondelez” is decidedly forgettable. Of course, this is partly because it isn’t as familiar, but research suggests that could be because of the weaker starting consonant, m.

    Wordplay (Puns)

    A wordplay (or pun) is a type of joke that plays on the fact that some words sound similar but have very different meanings. Some pun-inspired names are memorable for all the wrong reasons. In a quick search, I came across Bread Zeppelin, Wok This Way, and Nin Com Soup. I don’t know if they’re real, but you should tread carefully with puns unless you’re going after a certain demographic.

    Names that include puns certainly catch your attention. They might even be memorable. But is it for the right reason? Does it illuminate the depth of their brand, or is it just a cheap gimmick? Maybe it’s both.

    Brand Name Fit

    Some names sound like they fit with the other names in an industry. These sorts of names tend to be more memorable. For example, in a 1998 Journal of Marketing article, “The Effects of Brand Name Suggestiveness on Advertising Recall,” the authors claim the name “PicturePerfect Televisions” tests better for memorability than “Emporium Television.” PicturePerfect sounds more like the name of a TV brand than Emporium does, so meeting consumer expectations can be positive.

    It’s amazing to think the varied and unique names of millions of companies that exist were all created in just one of three different ways. But knowing that can help you focus and make smart choices as you work to come up with your own company name.

    The idea of brainstorming business names can feel completely overwhelming.

    Where do you even start?

    One way to dive into the task is to consider what type of company name you want.

    You already know there are 3 ways to create a business name. To make things a bit more interesting, there are also 3 different types of company names.

    Here are the major categories.

    How Business Names are Created

    Company names are created using either:

    1. Real words
    2. Constructed words – Invented words that come from recognizable parts of real words
    3. Completely invented words that are not recognizable in any way

    types of company names

    Company names fall into one of these three categories:

    1. Descriptive
    2. Suggestive
    3. Abstract

    A name will fit into each of those 2 groups. For example, a name can be:

    • descriptive and made of real words – like American Airlines
    • suggestive and made of a constructed word – like Mediavine

    Or any other combination of the 3 ways to create a business name and the 3 types of names.

    Some of the categories can actually be broken down into smaller sub-categories , but I’m a fan of keeping things simple, so we’ll stick with the fundamental types for now.

    Let’s look at each type and category in some detail.

    3 Ways to Create a Business Name

    1. Real Words

    This category is fairly straightforward. It describes any name that’s made of real words that exist in the language primarily used by your customers or where you do business. Alternatively, the name could be made of real words in a different language.

    At first glance, it might seem tough to create a distinctive business name using only real words. However, a clever combination of real words can form a name with real character.

    Example: Arm & Hammer

    2. Constructed Words

    This category describes names consisting of words that are made up in the sense that you won’t find the words in the dictionary. But they do come from a recognizable root word.

    Constructed words might be:

    • Compound words – Two real words put together to form a constructed compound word. Example: Pinterest
    • An existing word with a suffix added – A real word with a suffix that isn’t normally used with that word added to the end. Example: Shopify
    • An existing word with a prefix added – A real word with a prefix that isn’t normally used with that word added to the beginning. Example: Pantone

    3. Invented Words

    Invented words differ from constructed words because they are completely made up and not recognizable as real words. Ideally, invented words should feel like real words. They should be intuitive to read and spell.

    3 Types of Business Names

    1. Descriptive

    A descriptive name clearly describes the company’s product or service.

    The Organic Soap Shop is an example of a descriptive company name. It states clearly what the company sells.

    Some positive features of this type of name are: it is simple, easy to understand, customers know what you do, it’s probably easy to spell.

    It can be particularly tough to get the exact match blog domain name if you end up choosing a descriptive name. The URL will probably already owned by someone else.

    Also, a descriptive name can be tough to trademark because it is made of widely used terms.

    A soap maker in my area who was expanding and trademarking her business had to go through a name change. Her original business name was descriptive, similar to the example above and couldn’t be trademarked.

    The problem wasn’t that someone else already owned the name. The problem was she wasn’t allowed to own the words. You can’t own words like “organic soap” because they are so common. She had to completely change her business name to something else that could be protected by trademark.

    Keep in mind, I’m not a lawyer. If you do have questions about trademarking your business name or other legal issues, please consult with an actual lawyer.

    2. Suggestive

    A suggestive name doesn’t directly describe the company’s product or service, but it implies or evokes some quality of the company or the products.

    This type of business name is quite popular because it is meaningful and describes something about the company, but it also leaves room for fun, creativity, and adds some distinctiveness to the brand.

    Example: Suggestive, Real Word: Lush

    3. Abstract

    An abstract name doesn’t have any built-in meaning that’s tied to the business. The company will need to make that connection through strategic branding.

    An abstract business name is kind of like abstract art. The meaning of the name will be brought alive by the company.

    Example: Abstract, Real Word: Apple

    If you want to conduct business under a name other than your personal name, you need to register a business name.

    Follow these 5 steps to choose and register a business name:

    1. Choose your business name

    Decide on a name that’s right for your business. Your business name is a major element of your identity, image and brand. It should be:

    • memorable
    • easy to pronounce and spell
    • original and not similar to existing business names, company names or trade marks
    • appropriate, professional and not offensive
    • short
    • descriptive and functional (for example, Marketing Results) or new and quirky (for example, Google)

    Using your personal name

    You can use your personal name for your business (for example, Jane Smith).

    If you use your personal name as your business name, you don’t need to register it. But if you want to call your business ‘Jane Smith & Co’, you need to register the name, as ‘& Co’ is not part of your personal name.

    Rules and restrictions for naming your business

    There are certain words that you can’t use in your business name.

    You can find a list of restricted words, characters or expressions for business names on the Australian Securities and Investments Commission (ASIC) website.

    2. Check if your business name is available

    Also check Australian Trade Mark Search to make sure your business name isn’t already a registered trade mark. This way you won’t be infringing on someone else’s legal right to the name.

    3. Apply for your business name

    You need an ABN to register a business name. If you haven’t already got one, you can register for an ABN and your business name at the same time.

    Who can use the Business Registration Service?

    The BRS is currently available for new businesses starting as a sole trader, joint venture, company, trust, partnership or superannuation fund.

    If you’re one of these business types, you can apply for these registrations through the BRS:

    • Australian Business Number (ABN)
    • business name
    • goods and services tax (GST)
    • Australian company
    • pay as you go (PAYG) withholding
    • fringe benefits tax (FBT)
    • luxury car tax (LCT)
    • fuel tax credits (FTC)
    • wine equalisation tax (WET)
    • Administrator AUSkey

    If you’re an existing business with an ABN, you can also apply for your tax registrations through the BRS.

    4. Trademark your name

    Make sure you protect your business name or idea, including trademarking your name and logo. Just registering your business name doesn’t give you full automatic rights over the name.

    5. Renew or cancel your business name

    You will need to apply to renew or cancel your business name with ASIC.

    You must choose a name for your business if you’re setting up a private limited company.

    There are different rules for sole traders and business partnerships.

    Your name cannot be the same as another registered company’s name. If your name is too similar to another company’s name or trade mark you may have to change it if someone makes a complaint.

    Your name must usually end in either ‘Limited’ or ‘Ltd’. You can include the Welsh equivalents ‘Cyfyngedig’ and ‘Cyf’ instead if you registered the company in Wales.

    ‘Same as’ names

    ‘Same as’ names includes those where the only difference to an existing name is:

    • certain punctuation
    • certain special characters, for example the ‘plus’ sign
    • a word or character that’s similar in appearance or meaning to another from the existing name
    • a word or character used commonly in UK company names

    Example

    ‘Hands UK Ltd’ and ‘Hand’s Ltd’ are the same as ‘Hands Ltd’.

    You can only register a ‘same as’ name if:

    ‘Too like’ names

    You may have to change your name if someone complains and Companies House agrees it’s ‘too like’ a name registered before yours.

    Example

    ‘Easy Electrics For You Ltd’ is the same as ‘EZ Electrix 4U Ltd’

    Companies House will contact you if they think your name is too like another – and tell you what to do.

    Other rules

    Your company name cannot be offensive.

    Your name also cannot contain a ‘sensitive’ word or expression, or suggest a connection with government or local authorities, unless you get permission.

    Example

    To use ‘Accredited’ in your company’s name, you need permission from the Department for Business, Energy and Industrial Strategy (BEIS).

    Trading names

    You can trade using a different name to your registered name. This is known as a ‘business name’.

    Business names must not:

    If your business name is too similar to another company’s trade mark you may have to change it if someone makes a complaint.

    Displaying your name

    There are rules you must follow about displaying your company name.

    When you do not have to use ‘limited’ in your company name

    You do not have to use ‘limited’ in your name if your company is a registered charity or limited by guarantee and your articles of association say your company:

    • promotes or regulates commerce, art, science, education, religion, charity or any profession
    • cannot pay its shareholders, for example through dividends
    • requires each shareholder to contribute to company assets if it’s wound up during their membership, or within a year of them stopping being a shareholder

    You need to prepare a ‘memorandum of association’ and ‘articles of association’.

    You’ll need to register an official address and choose a SIC code – this identifies what your company does.

    Most people can register for Corporation Tax at the same time as registering with Companies House.

    If you cannot, register separately with HM Revenue and Customs (HMRC) after you’ve registered your company with Companies House.

    Creating a unique brand name in today’s world can be one of the single most challenging tasks a business will face. With an estimated 300 million+ companies in the world today, the chances of coming up with a name that has already been taken are high. A name needs to represent the overall mission of the company and encompass the brand positioning, values and tone of voice whilst at the same time ensure that it is ownable, pronounceable, spellable and has no negative connotations. In addition to this, a lot of names are already taken there’s only one option and that is to have a good creative process to work through.

    So why it’s a brand name so important?

    Having a unique brand name can have a huge impact on your business and can sometimes make or break a company if it’s not considered correctly. A strong brand name can build customer recognition, stand out in a potentially competitive market, create customer loyalty and enhance credibility while at the same time bring memorability to avoid being easily forgotten. But for this to happen there are a lot of factors you must take into consideration, so to help with the thought process we have broken down some of those key steps and also included how you can go about creating one.

    Make it memorable
    Finding a memorable brand name that your audience can remember for years to come. Just in the way that Google and Hoover have made their brand name part of the everyday language of many of their customers. However, this is not something that will happen overnight.

    Future-proofed
    Getting the name that resonates with your audience now, will enable it to transition with you through the key phases in your business’ journey. So, although your brand name has to work for the now, you must consider how it’d live and breathe in many years to come, how it could evolve without losing its essence. Not taking this point into account can potentially pigeon hole your business, especially if you want to expand into new areas in the future.

    User-friendly
    A name should be easy to pronounce and spell. A name without these qualities can potentially hinder the brand awareness and create frustration and annoyance between potential users or investors. Keeping a brand name short, to the point, and reducing the number of syllables is a good way to create a user-friendly name.     So with these things in mind, how do you go about naming your brand?

    A well-thought-out brief is the best place to start. The brief should include an outline around the business strategy and positioning, the target audience, who the competitors might be if any and any additional information that might be relevant. By having this in place you can get up and running quickly. On the contrary, it might take you twice as long to get to your brand name, risking your brand positioning not matching up to the expectations of your customers and endangering the success of your brand.     Choosing a business name

    Checking your business name is available

    Once you have chosen a name, you can contact the Australian Securities and Investments Commission (ASIC) to check that the business name is available.

    Applying for an Australian Business Number

    When you know your business name is available, you will need to have, or apply for, an Australian Business Number (ABN). When you apply for an ABN online through the Australian Business Register you can link straight to ASIC Connect to register your business name.

    Registering your business name

    Visit the Australian Government’s Business Registration Service to use a single form to apply for key business and tax registrations, including an ABN, business name, goods and services tax (GST), pay as you go (PAYG) withholding and fringe benefits tax.

    ASIC charge a fee for registering a business name. Your business name will not be registered until payment is received.

    You will receive a record of registration when you register or change a business name, or when an owner’s name changes.

    Displaying your business name

    You must clearly display your registered business name outside your Queensland business locations if the place of business is open to the public.

    You must publish your registered business name on all business correspondence and documents, such as business letters, invoices, account statements, publications, official notices, orders and receipts.

    Protecting your business name

    Registering a business name does not give you the same rights as registering a trademark. You do not own this name or have exclusive rights to use the name.

    If you want to protect your business name from being used by a competitor, you’ll need to register a trademark. You can then control the use of the name or any part of the name.

    Registering a business name will not stop someone who has registered the same name as a trademark from using it. You should always conduct a trademark search before deciding on a business name.

    Renewing your registration

    To keep using your business name you need to renew your registration before the expiry date. If you don’t renew your registration, your business name will be removed from the register and another business will be free to use it. You could then be stopped from using the name you have been trading under.

    Transferring a business name

    If you’re selling your business, you’ll need to transfer the business name if the new owner wishes to use it. If you’re the new owner you’ll need to register the name using the transfer number. Transferring a business name will incur a fee.

    Cancelling a business name

    A business name can be cancelled in 2 ways:

    • voluntary cancellation – if you no longer need your business name you will need to apply to cancel it through the ASIC Connect portal. There is no fee for cancelling a business name. Read more about cancelling your business name.
    • ASIC-initiated cancellation – ASIC may cancel the registration of a business name in certain circumstances.

    Reasons for Registering Your Fictitious Business Names

    A fictitious name (or assumed name, trade name or DBA name) is a business name that is different from your personal name, the names of your partners or the officially registered name of your LLC or corporation. Not all states require the registering of fictitious business names or DBAs. The main incentive is that, by registering the fictitious name, the owner of the business gains legal recognition of that assumed name. Consequently, the owner of the business can do things like opening a bank account under the assumed name and enforce contracts that were signed under the fictitious name.

    What is a Business Trade Name?

    A trade name is any name used in the course of business that doesn’t include the full legal name of all the owners of the business. In the case of a limited partnership, corporation, or LLC, it’s any name that differs in any respect from the name registered with the Secretary of State. The purpose of trade name registration is to provide a record of all owners of a business. You must register your trade name in order to file a lawsuit on behalf of your business.

    Registered information is public. Business name and entity filings are public records. Any information included on the registration form will be available to the public, including your home address if your business is home-based.

Only sole proprietorships can register a name currently being used by another business. Corporations and LLCs must choose a unique name.

    To find businesses in other states using your desired name or a similar one, do an internet search. Though you can register the same name, your businesses may be confused, particularly if the other business is regionally or nationally known. This can be a problem if the other business falls behind in financial obligations, encounters legal problems or another issue arises. In addition to checking your proposed business name, also look for similar names spelled differently, such as “shoppe” or “centre.”

    You may want to also make a trademark search, both nationally and in Idaho, to be certain you choose a name that is not trademarked.

    Note: Before 1998, business names were registered with county recorder’s offices. If you own or purchase a business that was originally registered with your county, be certain it has been re-registered with the Idaho Secretary of State’s Office.

    Try to ensure the name you apply for is unique, distinctive and not too similar to that of another company or business, especially one in a similar line of business.

    Names which are likely to be refused

    • are identical to a company or business name already registered in the Isle of Man;
    • are descriptive of a business activity but not distinctive;
    • are identical to a company known to exist elsewhere;
    • are grandiose and imply the company is in some way pre-eminent in its field (unless this is the case);
    • are not conducive to the good name of the Isle of Man;
    • are similar enough to an existing company or business name already registered in the Isle of Man, or known to be registered elsewhere, to cause confusion in the minds of those who might deal with the other business;
    • contain restricted words and phrases such as ‘Bank’ or ‘Building Society’;
    • contain words which imply royal patronage or connection, e.g. ‘Royal’, ‘Royalty’, ‘King’, ‘Queen’, ‘Prince’, ‘Princess’, ‘Windsor’;
    • do not contain an approved suffix, where one is required;
    • imply the company will be undertaking a regulated activity, without holding the appropriate licence;
    • were used by a company that has been struck off or dissolved in the preceding 5 years;
    • would indicate that the company may be engaging in illegal activities;
    • are registered for the main purpose of obtaining money (or other consideration) from a person who has goodwill in the same or sufficiently similar name elsewhere;
    • imply a relationship or association with a government department or statutory board.

    The Companies Registry does not consult any Trade Mark Index or other Trade Mark Register. Approval of a name is not an indication that no trade mark rights exist over it.

    There is no Trade Mark Index in the Isle of Man, but Isle of Man Trade Marks are included in the UK Trade Mark Index.

    An Online Account is required in order to check name availability. Go here to Create an Online Account. If you already have an online account, you can sign in before proceeding with the following steps.

    Scroll down to the list titled “File a New Business or Nonprofit.” Click on the business structure your business will be set up and registered as.

    Depending on which type you choose you may or may not need to answer questions about non-profit status and professional status.

    To verify the name you would like for your business is available, type the proposed name into the search box. Then select the entity designation from the drop-down menu on the right (where applicable). Be sure to double check the business name before proceeding.

    It is very important to choose the end of your business name from the drop-down menu instead of typing it in. The system will automatically add the default ending to your business name based on your business structure if you do not choose from the drop-down menu.

    Example: The business you’re registering is “ABC Trucking, Inc.” If you type “Inc.” at the end of the name instead of selecting it from the drop-down menu, the business name will be registered as “ABC Trucking, Inc. Co.” since “Co.” is the first option on the menu.

    Here are the rules for which words are allowed to be in specific business names:

    If an entity designation is included in the name of an Assume Name, at least one of the name holders must have an equivalent entity designation in their name.
    Exception: “Company”, “Co”, or “Companies” when used by itself in the name and not as part of a longer entity designation.

    Only use ‘Cooperative’ or ‘Coop’ or variations of those terms in your assumed name if you are a registered cooperative or you operate your business on a cooperative model by providing rebates of net profits to your members.

  • Once you enter the name and hit Search the system will let you know if the business name is available or not. If it’s not available, the name and file number of each conflicting business already on file will be provided.
